Suspension of CAP MR/DD Cost Reports 
  
DHHS Secretary Lanier Cansler has suspended mandatory cost reporting for CAP MR/DD, residential treatment and enhanced mental health service providers.  This suspension affects any Mental Health Cost Report due after December 31, 2009.  Any cost report due on or before 12/31/2009 is still required to be completed and submitted if it hasn't been already.  Any provider currently on withholding due to an over due cost report will stay on withholding until a completed cost report is received.
 
At this time I have no idea when the suspension will be rescinded, but the Office of the Controller strongly encourages providers to keep current systems in place to keep up with their cost report information.  So when the suspension is rescinded, a cost report can be filed.  For example if the suspension were to be rescinded on 12/31/2010, then a cost report from providers with a 12/31/2010 year end would still be due on 5/31/2011.
 
A copy of the Secretary's letter is currently posted on the Office of the Controller's website http://www.ncdhhs.gov/control/amh/amhcost9.htm.   We also plan on mailing a copy of the letter to each CAP MR/DD, residential treatment and enhanced mental health service providers that we know of.

Analysis of MH/DD/SAS Service Gaps Draft Report
Communication Bulletin #108 has been posted to the DMH web page.  http://www.ncdhhs.gov/mhddsas/announce/index.htm  

The Draft report and appendices have been posted on the Division website to provide our partners and the public an opportunity to review and provide comments before the report is finalized and submitted to the Joint Legislative Oversight Committee on Mental Health, Developmental Disabilities, and Substance Abuse Services and General Assembly. Comments are due by February 28.

Williamson Receives Achievement Award

Lee Williamson is one of those people who is just great at multi-tasking.

He works three days a week at the Beaufort County Developmental Center in Washington, attends Beaufort County Community College two days a week and still manages to spend time with his family and help out around their home in Aurora.

Williamson's hard work was recently recognized by the North Carolina Association of Rehabilitation Facilities, which presented him its Personal Achievement Award for what was called his "significant personal growth and achievement."

Williamson said he wasn't expecting the award, but the recognition came as no surprise to BCDC staff.

"Lee is a very responsible and hard working employee. He is punctual and focused on getting the job done efficiently and correctly," said Chris Kiricoples, BCDC's chief executive officer. "He has a positive attitude, a winning and warm smile and always displays exceptional manners and professionalism in the workplace and the community."

The link directs you to the DHHS' 1915(b) waiver amendment which includes characteristics of the new waiver over an identified period of time. This is not the DHHS' waiver RFA (request for applications) that will include the readiness criteria for LME applicants as well as other requirements. The RFA should be posted before the end of the month.



DRNC Files Complaint Against PBH
 
Today, DRNC filed a class action Complaint against Dan Coughlin, the Area Director of Piedmont Behavioral Healthcare and Secretary Lanier Cansler.   The suit challenges Piedmont's actions in cutting the reimbursement rate for Supervised Living Services from $162 to $116.  The suit alleges that the new rate proposed by PBH, scheduled to take effect on Monday, February 15, would constructively abolish that service for PBH's clients, as providers would no longer offer the service at a rate which would guarantee a loss for the provider.
 
The named plaintiffs, Clinton L. and Timothy B., are two former members of the Thomas S. class who have lived successfully in the community supported by Supervised Living services.  Both plaintiff had already been informed by their providers that their residential placements would be terminated owing to the new reduced rate.
 
The motion for a Temporary Restraining Order and Preliminary Injunction case has been referred to Chief Judge James A. Beaty, Jr.
